Legal
Terms of Service.
These terms govern your use of the Agent Amplified website. If you become a client, a separate signed services agreement governs the work we do for you and takes precedence over anything below.
01Agreement
These Terms of Service (“Terms”) are a legal agreement between you and Agent Amplified (“Agent Amplified,” “we,” “us,” or “our”), operating from [Registered address, City, Province/State, Country]. By using the site, you agree to these Terms.
If you become a client, a separate written services agreement (an SOW, proposal, or master services agreement) will govern the specific work. In the event of a conflict, the signed services agreement controls over these Terms.
02Use of the site
You may use this site for lawful, personal or business purposes. You agree not to:
- Copy, republish, or resell content from the site without written permission.
- Reverse engineer, extract, or attempt to derive our internal systems.
- Use automated tools to harvest data, credentials, or content in a way that violates the site’s access controls.
- Interfere with the operation of the site, upload malware, or attempt to gain unauthorized access.
- Use the site to send spam, deceptive content, or anything that violates applicable law.
We may suspend or restrict access to the site at any time, with or without notice, if we believe use of the site is putting the service, our clients, or other users at risk.
03Our services
Agent Amplified provides marketing services to real estate agents and brokerages. Depending on your engagement, services may include:
- Buyer marketing (paid ads, IDX funnels, follow-up automation).
- Seller marketing (home-valuation funnels, just-listed/just-sold campaigns, farm-area content).
- Brand identity, website design and build, and CRM setup.
- Local SEO, Google Business Profile, and answer-engine (AEO) optimization.
- Related design, copywriting, and reporting.
The exact scope of your engagement will be described in a signed proposal, SOW, or services agreement.
04Fees & billing
Pricing shown on the site is in [USD] and is illustrative until confirmed in a signed proposal. Once you become a client:
- Recurring fees are billed monthly in advance on the anniversary of your start date.
- Ad spend is separate. You fund media directly on your own Meta, Google, TikTok, LinkedIn, or other ad accounts — not through Agent Amplified.
- Setup or one-time fees (websites, brand identity, migrations) are quoted in the proposal and billed on the schedule stated there.
- Late payments may incur a [1.5%] per month late fee, and we may pause services until the account is current.
- Taxes (GST/HST, PST, state sales tax) are added where required by law.
- Refunds are governed by the signed services agreement. Recurring fees for the current billing period are non-refundable once services for that period have begun.
05Term & cancellation
Recurring engagements are month-to-month unless a specific term is agreed in writing. Either party may cancel with [30 days]’ written notice before the next billing date. The current month’s work continues through the end of the paid period.
We may terminate an engagement immediately if you materially breach these Terms or the signed services agreement, fail to pay after reasonable notice, or ask us to do work that violates applicable law, an ad platform’s policies, or professional real estate regulations.
06Client obligations
To do our job well, we need you to:
- Provide accurate information about your brokerage, licensing, and market.
- Grant timely access to ad accounts, CRM, website, and any other systems in scope.
- Respond to strategy questions and approval requests within a reasonable time.
- Comply with applicable real estate advertising rules in your jurisdiction (RECA, RECO, CREA, NAR, state real estate commissions, MLS rules).
- Ensure that any content, listings, or client data you send us is yours to share.
- Handle leads generated by our campaigns in compliance with anti-spam law (CASL in Canada, TCPA and CAN-SPAM in the US) and your local privacy law.
07Intellectual property
Site content. Everything on this site — text, graphics, logos, code, and design — is owned by Agent Amplified or its licensors and is protected by copyright and trademark law.
Client deliverables. When we deliver work under a paid engagement, you own the final deliverables (websites, brand identity assets, ad creative, written content) once the invoice for that work is paid in full. We retain ownership of our underlying methods, templates, playbooks, and internal tools.
Portfolio use. Unless your services agreement says otherwise, we may reference the work we did for you in our portfolio, on this site, on social media, and in sales conversations — including your brand name, logo, and non-confidential outcomes.
08Confidentiality
Each party will treat the other’s confidential information (business data, lead lists, financials, strategy, and anything reasonably marked or understood as confidential) as confidential, use it only to perform the engagement, and protect it with reasonable safeguards. This obligation survives termination.
09Warranties & disclaimers
We will perform our services with reasonable care and skill, consistent with professional marketing practice. Beyond that:
- The site and its content are provided “as is” and “as available”.
- We make no guarantee of specific results — number of leads, cost per lead, listings signed, closings, ad performance, search rankings, or revenue.
- Any figures shown on this site are illustrative or drawn from past engagements. Individual results vary based on market, offer, ad spend, product-market fit, and factors outside our control.
- To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10Limitation of liability
To the fullest extent permitted by law, Agent Amplified is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost commissions, lost listings, lost data, or loss of business opportunity, even if we were advised of the possibility.
Our total aggregate liability for any claim arising from these Terms or any engagement is limited to the fees you paid to Agent Amplified in the [3] months immediately before the event giving rise to the claim. This limit is the maximum, in aggregate, for all claims combined.
11Indemnity
You agree to indemnify and hold Agent Amplified, its owners, and its contractors harmless from any third-party claim arising from (a) content or data you provide us, (b) your breach of these Terms, (c) your use of deliverables in a way that violates law or platform policies, or (d) your handling of leads and clients generated by our services.
12Third-party platforms
Our services depend on third-party platforms (Meta, Google, TikTok, LinkedIn, ad networks, CRMs, ISPs, MLS boards, and others). We are not responsible for their downtime, policy changes, account suspensions, approval decisions, or price changes. If a third-party platform changes in a way that materially affects the engagement, we’ll work with you in good faith to adjust the plan.
13Governing law & disputes
These Terms are governed by the laws of [Province/State, e.g. Saskatchewan, Canada], without regard to conflict-of-laws principles. The courts of [City, Province/State] have exclusive jurisdiction over any dispute arising from these Terms, and each party consents to that jurisdiction.
Before starting any legal action, the parties will attempt in good faith to resolve the dispute through [30 days] of direct negotiation.
14Changes to these terms
We may update these Terms from time to time. When we do, we’ll change the “Last updated” date at the top. If the changes are material, we’ll announce them on the site or notify active clients by email. Continued use of the site after an update means you accept the revised Terms.
